Overview

We ("Botsheets Inc.", "Exit Path" "we", "our", or "us") have the greatest respect for your ("your", "you", "your business", "user", including "your users") information and data and we expect you to have the same level of respect for our service including Exit Path content, community, software, and related support services (the "Service" or "Services"). We are committed to operational excellence and delivering the best possible experience for every Exit Path user. The Exit Path Service is owned, operated and managed by Botsheets Inc. (hereinafter referred to as Exit Path), a corporation based in Huntingdon Valley, Pennsylvania, United States of America.

Access To The Service

Access to the Service is only permitted subject to acceptance of these TOS, which Exit Path shall be free to modify at any time without prior notice to you. It is your sole responsibility to access this page and ensure that you are in compliance with the most up-to-date version of the TOS at www.exitpath.ai/terms. By accessing and using any part of the Service, you agree not to engage in any of the following activities 1) Attempt to send or store data other than through means explicitly provided by the Serivce, 2) Attempt to reverse engineer the Service, 3) Attempt to share any content that is offensive to others, slanderous, pornographic in nature, or otherwise may be considered inappropriate for public consumption. We reserve the right to block you from the Service, with no prior notice to you for any reason. You shall hold Exit Path harmless in the event of any claim, in one or other of the following cases: 1) Loss of opportunities, or of business income linked to the functioning or non-functioning or use or non-use of the Service, or content available through the service; 2) Illegal or unauthorized access to the Service by any third party, including any intrusion to Exit Path servers; 3) Any network conditions that may affect the speed or performance of the Service;

If you are paying Exit Path for use of the Exit Path Services, you will be granted such access immediately after payment has been processed by our payment processor and we receive confirmation. If your payment is declined for any reason, or your payment method expires, we reserve the right to terminate access to any paid Service features without notice, but we will provide an explanation through email or programmatically through our Services. Access to any paid Service will be restored within 24 hours of reciept of payment by Exit Path.

You accept that all of our Services shall function "as is" and that any function of the services, including aspects of the Services which are dependent on third parties, including Sub-Processors and Affiliates are subject to change, or removal without prior notice to you. Exit Path alone shall decide on the expediency of inclusion, or removal of any feature of the Service, or any content available through the Service on its own timeline and at its sole discretion for any and for no reason at all.

Warranty Disclaimer

Exit Path reserves the right, at any time and on any grounds whatsoever, to alter or temporarily, or permanently discontinue any, in whole, or in part, features, and access to the Service, without informing you prior to. Exit Path shall not be held liable for any direct or indirect loss or damage associated with an alteration or suspension of or interruption in access to the Service, the accuracy or inaccuracy of data, or your inability to access the Service, for any reason whatsoever.

The text, code, logos, drawings, brand names, models, slogans, graphic charts, concepts, etc. accessible through the Service (collectively "Content"), either directly or indirectly through third parties may be protected by intellectual and/or industrial property rights. Except where expressly authorized by Exit Path and/or a third party maintaining such rights, you shall not be allowed to modify, reproduce, rent out, borrow, sell, distribute or create derivative works based entirely or partially on the elements contained on the website, applications or through any part of the Service. It is therefore not allowed (and may not authorize other people) to copy, modify or create a derivative work, reverse the design or assembly or attempt in any other way to find the source code, sell, grant, sublicense or transfer in any way whatsoever, any right relating to Content accessible through the Service, or any part of the Service.

Your Data

Any data that you provide to the Service, including but not limited to messages, text, graphics, audio, video, and personal data (collectively, "Data") you retain your rights to, or where such rights have been granted directly to you. You hereby grant Exit Path, without any compensation to you, a perpetual, irrevocable license to publish, re-publish, format, reformat, transmit, process, upload, download, and store any Data you provide or connect to the Service.

We respect your privacy and all Data collected by Exit Path through your use of our Service. We do not sell your Data to third parties and make every commercially reasonable effort to protect your Data. By allowing the service to access your Data, you expressly authorize Exit Path to process Data for the following purpose: 1) Grant you access to certain features of the Service; 2) Create backups and to store, project and manage Data for the benefit of operating the Service; 3) Improve the quality of the Services offered including using your Data in aggregate form to create or improve language models to enable Service; 4) Inform you of interruptions in Services, new features of the Service and generally provide support to you for your use of the Services 5) Execute our obgligations to processing personal data ("Processing Personal Data") and 6) Disclose your Data at the request of a legal authority or in a bona fide course of action where it is deemed that this is required in order to comply with any law or regulations in force.

Exit Path undertakes strict measures to protect the security of your Data and implements the security procedures and technologies needed to prevent unauthorized access to your Data. Your Data is stored on restricted-access computer systems installed in premises protected by surveillance. By means of a dated and signed written request, you can, after supplying proof of your identity, via a written statement, free of charge, request the correction of any particulars that are incorrect, incomplete or irrelevant, or the removal of your Data entirely from our computer systems, servers, and the Services in general. Notwithstanding, limited Data may be retained by us indefinitely, even if you terminate your access and/or use of the Services, but we would only use such Datain aggregate form, that is, in a manner that would identify you personally. This enables us to maintain data integrity in our reporting, and in order to analyze, optimize, and improve the delivery of our Services. We have instituted script measures to protect personal Data, highlighted through our Privacy Policy located at Privacy Policy, and more explicitly governed by our Data Processing Agreement. It is your responsibility to ensure you comply with all international copyright and privacy laws. It is our responsibility to respect and protect your Data in accordance with these laws.

At Exit Path, we prioritize GDPR compliance, employing Standard Contractual Clauses (SCCs) as a crucial mechanism for data protection. SCCs are legal tools that allow us to transfer data to and from from non EEA regions, ensuring these transfers meet the GDPR's strict privacy and security standards. By incorporating SCCs into our operations, we provide a secure framework for data handling that aligns with international data protection requirements.

While Exit Path is committed to upholding GDPR compliance through SCCs and other measures, it's important to note that the suitability of SCCs may depend on the individual circumstances of your business. We adhere to GDPR principles in every aspect of our operation, but we advise consulting with counsel to confirm if SCCs will be a valid transfer mechanism for your use of Exit Path.

Our engagement with customers is firmly based on GDPR-compliant terms and conditions. We support your data needs and adhere to GDPR's data retention policies by automatically deleting visitor data after 30 days.

In our commitment to data security, all third-party vendors we use are aligned with our GDPR requirements, ensuring the protection of your data. We secure data transfers with 256-bit encryption and mandate that our API and application endpoints use TLS/SSL protocols exclusively.
